Dar-ul-Qaza
Dar-ul-Qaza
Shaheen Jama Masjid Trust proposes to establish a Dar-ul-Qaza to assist individuals and families in resolving family and marital disputes through Islamic guidance, mutual consultation and amicable reconciliation. The initiative will seek to promote justice, fairness, mutual understanding and the preservation of family relationships.
The Dar-ul-Qaza will focus particularly on matters relating to marital disagreements, family disputes, reconciliation between spouses, and other appropriate personal matters. Wherever possible, efforts will be made to resolve disputes through dialogue, counselling and mediation, with the free and informed consent of the parties concerned.
Qualified Islamic scholars and suitably experienced individuals will be involved in guiding the process, ensuring that both parties are heard fairly and that their concerns are considered with dignity, impartiality and confidentiality. Where reconciliation is not possible, the parties may be guided regarding the appropriate religious and legal procedures available to them.
The Dar-ul-Qaza will function within the limits of applicable Indian law. It will not claim the powers of a civil or statutory court, and participation in mediation or reconciliation will remain voluntary. Matters requiring a legally binding decision or formal legal remedy will be referred to the appropriate competent authority or court.
Through this initiative, the Trust aims to reduce unnecessary family conflicts, encourage peaceful settlements, protect the dignity of individuals and strengthen family and community relationships in accordance with Islamic principles and the law of the land.
